Welcome to SkynetXBT, an artificial intelligence-powered trading simulation platform that enables Users to observe, analyze, and learn from autonomous AI trading agents executing simulated cryptocurrency trading strategies. Our Platform leverages sophisticated machine learning algorithms and real-time market data to demonstrate automated trading decisions in a simulated environment for educational and research purposes only. All trading activities displayed on the Platform are simulations and do not involve actual financial transactions or real money.

SIMULATION PLATFORM ONLY: SkynetXBT is a simulation and educational platform that does not facilitate, execute, or process any actual cryptocurrency trades, financial transactions, or real-money trading activities. All trading agents, trading strategies, market positions, profit and loss calculations, and performance metrics displayed on the Platform are simulated for educational, research, and demonstration purposes only. No real funds, cryptocurrencies, or financial assets are at risk or involved in any capacity.

NO FINANCIAL ADVICE: The Services provided by SkynetXBT, including but not limited to simulated AI trading agents, algorithmic trading demonstrations, market analysis, and any related information or data visualizations, are provided solely for informational, educational, and technological demonstration purposes and do not constitute financial, investment, trading, or legal advice. Users acknowledge and agree that SkynetXBT does not provide personalized investment recommendations or advice regarding actual trading or investment strategies.

EDUCATIONAL PURPOSE: The Platform is designed to: (a) demonstrate artificial intelligence capabilities in analyzing market data; (b) provide educational insights into algorithmic trading concepts and strategies; (c) enable Users to observe and study trading patterns and decision-making processes in a risk-free simulated environment; and (d) facilitate research and learning about cryptocurrency markets without financial risk. Simulated performance results do not represent actual trading performance and should not be relied upon as predictive of results in actual trading scenarios.

NO REAL TRADING OR FINANCIAL SERVICES: Users expressly acknowledge and understand that: (i) SkynetXBT does not operate as a broker, dealer, exchange, investment advisor, or financial services provider; (ii) no actual buy or sell orders are placed on any exchange or trading venue; (iii) all displayed transactions are simulated and hypothetical; (iv) Users do not deposit, transfer, or withdraw any real funds or cryptocurrencies through the Platform; and (v) no actual profits or losses can be realized from simulated trading activities.

ACTUAL TRADING RISKS: Should Users choose to engage in actual cryptocurrency trading based on knowledge or insights gained from the Platform, they acknowledge that: (a) real cryptocurrency trading involves substantial risk of financial loss; (b) simulated performance does not guarantee or predict actual trading results; (c) actual market conditions, execution costs, slippage, and other factors materially differ from simulated environments; (d) Users should conduct independent research and consult qualified financial professionals before engaging in any actual trading; and (e) SkynetXBT bears no responsibility for any actual trading decisions or outcomes made by Users outside the Platform.

LIMITATION OF LIABILITY: To the maximum extent permitted by applicable law, SkynetXBT, its affiliates, officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from or related to: (i) use of the simulation Platform and Services; (ii) reliance on simulated performance data or AI agent strategies; (iii) any actual trading decisions made based on information observed on the Platform; or (iv) any other matter relating to the Platform, whether based in contract, tort, negligence, strict liability, or otherwise.

2. What Information Do We Collect

2.2We may collect and receive Personal Data from You when You access Our Platform, register for a User Account with Us, or when You connect Your User Account with an external third- party.

Important Clarifications on Data Handling:

No Personal Data Storage from Google Services for AI Training:We want to assure our users that any personal data you provide to us through Google services (e.g., if you sign up using a Google account or integrate with Google-related features) is not stored by us for the purpose of training our internal AI models.
Use of Third-Party AI APIs:When you interact with features on our Platform that utilize these external AI services, certain data necessary for the AI to function (e.g., your queries or inputs to an AI-powered tool) may be sent to these third-party API providers. However, we have implemented measures and rely on our agreements with these providers to ensure that your personal data is handled in accordance with their respective privacy policies and our commitment to your privacy.
No Training of Our AI Models with Your Data:We explicitly state that we do not use the personal data you provide through our Platform to train our proprietary AI models. Our engagement with AI technologies focuses on utilizing the capabilities of established, reputable AI API providers to deliver specific functionalities within our Services, without compromising your personal data for our internal model training.
Your Data Stays With Us (as per policy):Any personal data we collect directly from you, as outlined in Section [Refer to your What Information Do We Collect section, e.g., 2] of this Privacy Policy, is processed, stored, and used strictly in accordance with the terms herein and is not shared with these external AI API providers for their model training purposes.

By using our Services, you acknowledge and agree to our use of these third-party AI API providers under the terms described in this Privacy Policy. We continuously review our practices and relationships with third-party providers to ensure the highest standards of data privacy and security.

The use of raw or derived user data received from Workspace APIs will adhere to the Google User Data Policy, including theLimited Use requirements.

4. IS THE PERSONAL INFORMATION OF THE USER SECURED?

Your account is protected by a password for Your privacy and security. If You access Your account via a third-party site or service, You may have additional or different sign-on protections via that third party site or service. You must prevent unauthorized access to Your account and Personal Information by selecting and protecting Your password and/or other sign-on mechanism appropriately and limiting access to Your computer or device and browser by signing off after You have finished accessing Your account. We endeavor to protect the privacy of Your account and other Personal Information We hold in Our records, but unfortunately, We cannot guarantee complete security. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of User information at any time.

I. Data Processing Agreements

Under the GDPR, "Data Controllers" (i.e. entities that determine the purposes and means of processing data) are required to enter into agreements with other entities that process data on their behalf (called "data processors"). SkynetXBT offers its customers who are controllers of EU personal data. This includes SkynetXBT's commitment to process Personal Data consistent with the instructions of the data controller.

III. Data Security

The GDPR requires organizations to use appropriate technical and organizational measures to protect the security, confidentiality, and integrity of personal data. This means that an independent third party has both validated our processes and practices with respect to these three trust services criteria and confirmed our ability to maintain compliance with the controls we have implemented. We have likewise implemented a variety of safeguards to protect the security of our platform, including encrypting web connections to protect data transmissions, replicating our databases to support reliability of the platform, and controlling access to our facilities and office network. SkynetXBT also offers customers the ability to use additional security controls to further enhance the security of their teams' data.

IV. California Consumer Privacy Act (CCPA)

The CCPA, which comes into force on January 1, 2020, is a law that provides California consumers certain rights with respect to their personal information. Specifically, the law requires that businesses subject to the statute grant consumers the ability to request access to and deletion of their data, and the ability to opt out of "sales" of their personal information. The law also restricts how service providers that process personal information on behalf of a business may use that information.
SkynetXBT does not sell its Consumers' or Users' personal information. Where a business subject to the CCPA has entered into a services or subscription agreement with SkynetXBT, SkynetXBT will also act as a service provider to that business. Specifically, SkynetXBT will process such consumers' personal information only for the purposes set forth in the applicable agreement, and will cooperate with consumers to fulfill deletion or access requests.
Ongoing Compliance and Communication Both the GDPR and CCPA's requirements are comprehensive, but the law and regulatory guidance continues to evolve when it comes to privacy and data protection – and not just in the EU or the United States. As data protection authorities and regulators interpret and issue guidance on the GDPR, CCPA, and other currently existing data protection laws around the world and as countries pass new data protection laws, we will continue to follow these developments closely and evaluate our program for any changes or enhancements as needed.

2. Family Educational Rights and Privacy Act

The Family Educational Rights and Privacy Act (FERPA) is a federal law that requires academic institutions like colleges and universities to protect the privacy of students' educational records. SkynetXBT enables our customers to comply with FERPA by ensuring personal data is kept secure and only used to provide our services as described in our Terms of Service and Privacy Policy. SkynetXBT contractually commits to not disclosing customer data except as directed by the contracting academic institution, as allowed by our terms, or as required by law.

3. Act on the Protection of Personal Information

The Act on the Protection of Personal Information (APPI) is the primary data protection law in Japan that regulates the protection of personal information. It applies to business operators handling personal information of individuals in Japan. The APPI has been amended since it was originally enacted in 2003, with the most recent amendments coming into effect April 1, 2022.
Similarly, to the distinction between "data controllers" and "data processors" under the GDPR, the APPI makes a distinction between "business operators" - or entities with the authority to control and make decisions about retained personal information (i.e. SkynetXBT's customers) and third-party service providers handling personal information on behalf of a business operator (i.e. SkynetXBT).
The APPI also imposes restrictions on cross-border transfers of personal information outside of Japan. Personal information may be transferred to overseas recipients if there are contractual agreements in place that ensure compliance with data protection standards in Japan.
SkynetXBT is committed to processing and safeguarding personal information as required by the APPI and its amendments.

8. Data Security and Integrity

We take steps that are reasonably necessary to securely provide our Platform. We have put in place reasonably appropriate security measures designed to prevent your personal data from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed. We limit access to personal data only to those employees, agents, contractors and the third parties who have a business need-to-know. We also have procedures in place to deal with any suspected data security breach. If required, We will notify You and any applicable regulator of a suspected data security breach. Afterwards, We retain some information in a depersonalized or aggregated form but not in a way that would identify You personally.
